Welcome to Holodex.com! These Terms of Service (“Terms”) govern your use of Holodex and its associated services, including:
- Holodex.com – Our adult content platform featuring visual search, model profiles, and exclusive BTS content.
- Holodex Sites – Custom performer sites powered by Holodex, enabling models to control and monetize their content.
- Performer HQ – A secure area for verified performers to publish content and manage their accounts.
By accessing or using Holodex, you agree to these Terms. If you do not agree, please do not use the platform.
1. Eligibility and Access
a) Age Requirement
Holodex is strictly for users 18 years or older (or the age of majority in your jurisdiction). By using the site, you confirm that you meet this age requirement.
b) Performer and Agency Verification
- Performer Accounts: Performers must complete a manual verification process, including providing ID documentation and 2257 compliance materials, before gaining full access to Performer HQ.
2. Account Registration and Security
a) Creating an Account
To access certain features, you must create an account. You agree to provide accurate information and update it as necessary.
b) Account Security
You are responsible for safeguarding your account credentials. Notify us immediately at dave@holodex.com if you suspect unauthorized use. Holodex is not liable for losses resulting from compromised accounts.
3. Content and Usage Guidelines
a) Acceptable Use
You agree not to:
- Upload, share, or publish illegal, defamatory, or infringing content.
- Harass, exploit, or engage in non-consensual activities with performers or users.
- Attempt to bypass security measures or tamper with the platform.
b) Performer Content Control
- Holodex Sites: Performers maintain full control over the content uploaded to their Holodex-powered sites.
- Performer HQ: Verified performers may publish content directly to Holodex and manage their financial data.
c) Prohibited Content
Content that violates 18 U.S.C. §2257 or contains the following is strictly prohibited:
- Child sexual abuse material (CSAM)
- Non-consensual content (including revenge porn)
- Extreme violence, animal abuse, or any illegal acts
Violators will be reported to law enforcement and permanently banned.
4. Performer-Specific Terms
a) Content Ownership
Performers retain ownership of all content uploaded to their Holodex Sites or Performer HQ. By uploading content, performers grant Holodex a license to host, display, and distribute the content to users and verified partners.
b) Revenue and Commission Structure
- Holodex Sites: Performers pay a one-time onboarding fee of $500 per site and agree to a 20% commission on all content sales generated through the platform.
- Performer HQ: Free to use for verified performers who choose not to create a full Holodex site.
c) Performer Termination
Holodex reserves the right to terminate performer accounts that:
- Upload illegal or non-consensual content.
- Fail to maintain compliance with 18 U.S.C. §2257.
- Engage in fraudulent or abusive activities.
5. Payments and Refunds
a) Payment Processing
All payments are securely processed through third-party providers. Holodex does not store credit card information.
b) Refund Policy
Refunds are only issued under the following conditions:
- Duplicate charges or billing errors.
- Technical issues preventing access to purchased content.
Subscription fees, onboarding fees, and booking commissions are non-refundable.
6. Intellectual Property
a) Ownership
All content, trademarks, and intellectual property associated with Holodex remain the property of Holodex. Performers retain ownership of their uploaded content.
b) License to Use
By uploading content, you grant Holodex a non-exclusive, worldwide, royalty-free license to host, distribute, and promote your content through the platform.
7. Limitation of Liability
a) No Guarantees
Holodex provides its platform on an “as-is” basis without warranties. We do not guarantee that the site will operate without errors or interruptions.
b) Limitation of Liability
To the fullest extent permitted by law, Holodex is not liable for any indirect, incidental, or consequential damages arising from your use of the platform.
8. Suspension and Termination
a) Suspension
We may suspend or terminate accounts that violate these Terms or engage in harmful activities.
b) Termination by User
You may terminate your account by contacting dave@holodex.com. Account termination does not guarantee the immediate removal of content already published.
9. Privacy and Compliance
a) Privacy Policy
Your use of Holodex is also governed by our Privacy Policy, which explains how we collect, use, and protect your information.
b) 2257 Compliance
Holodex complies with 18 U.S.C. §2257 and requires all performers to provide appropriate documentation before publishing any adult content.
10. Changes to These Terms
We may update these Terms from time to time. Significant changes will be communicated via email or through the Holodex platform. Continued use of the site after such changes constitutes your acceptance of the updated Terms.
11. Governing Law
These Terms are governed by the laws of United Kingdom. Any disputes arising under these Terms will be resolved in the courts of united Kingdom.
